asciify.art respects intellectual-property rights and applicable law. This page describes how to report content on the Service that you believe infringes your rights or is otherwise unlawful, and how we handle such reports. This procedure satisfies notice obligations under the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and Article 16 of the EU Digital Services Act (Regulation (EU) 2022/2065).
1. Designated contact
Send all notices to: support@tomasgrasl.cz with the subject line NOTICE: takedown request. This is the single point of contact for both rightsholders and authorities.
2. What your notice must include
For us to act on a notice, please provide:
- Your full name and contact details (email is enough; postal address if you act on behalf of an organisation);
- The exact URL(s) on asciify.art of the content you are reporting;
- A clear description of the alleged infringement or unlawful character of the content (e.g. the original work, the trademark, or the specific provision of law);
- For copyright claims, a statement that you have a good-faith belief that use of the material is not authorised by the rightsholder, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the rightsholder or authorised to act on the rightsholder's behalf;
- Your physical or electronic signature (typing your full name is accepted).
Incomplete or abusive notices may be rejected. Knowingly false notices may expose you to liability for damages, including costs and attorneys' fees, under DMCA § 512(f) and applicable EU law.
3. How we handle notices
We aim to acknowledge complete notices within a reasonable time and to act on valid notices promptly, in line with our duties under applicable law. Action may include removing or disabling access to the reported content, contacting the user who submitted it, and keeping records for our internal logs.
4. Counter-notice
If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to support@tomasgrasl.cz with the subject line COUNTER-NOTICE. Include:
- your contact details;
- identification of the removed content and where it appeared;
- a statement under penalty of perjury that you have a good-faith belief the content was removed as a result of mistake or misidentification;
- your consent to the jurisdiction of the courts of the Czech Republic, or, if you are in the United States, the federal district court for the judicial district where you live;
- your physical or electronic signature.
We may forward your counter-notice to the original complainant. We may restore the content if appropriate after a reasonable period unless we are notified that legal action has been initiated.
5. Repeat infringers
We will, in appropriate circumstances, suspend or terminate access for users (including by IP address or anonymous submitter identifier) who are determined to be repeat infringers.
6. Other unlawful content
For content that is not copyright-infringing but is otherwise unlawful (e.g. defamation, hate speech, content endangering minors), please use the same contact and clearly explain the legal basis. We will assess and act in accordance with applicable law.
7. Out-of-court redress
Users in the EU whose content has been moderated have the right to use certified out-of-court dispute-settlement bodies under DSA Art. 21 once such bodies are designated for this Service. In the meantime, please first contact us at the address above.
