These Terms of Service ("Terms") govern your access to and use of asciify.art(the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service is a free online tool that converts images and text into ASCII art and lets users optionally publish creations to a Community Gallery. The Service is operated by Tomáš Grasl("Operator", "we", "us"), contact support@tomasgrasl.cz.
2. Eligibility
You must be at least 16 years old, or the minimum age required by your local law to consent to processing of personal data, to use the Service. By using the Service you represent that you meet this requirement.
3. Acceptable use
You agree NOT to:
- upload, generate, or publish content that is unlawful, infringing, defamatory, obscene, sexually explicit involving minors, threatening, harassing, hateful, or that incites violence;
- upload content for which you do not hold the necessary rights or permissions, including images, logos, characters, or text protected by copyright, trademark, or personality rights;
- attempt to disrupt or compromise the Service, including denial-of- service attacks, scraping at abusive rates, exploiting vulnerabilities, or bypassing rate limits or moderation;
- use the Service to send spam, phish, distribute malware, or commit fraud;
- use the Service to train machine-learning models against the published Community Gallery without our prior written permission;
- misrepresent your identity or impersonate any other person;
- remove or obscure copyright, attribution, or other proprietary notices.
We may remove content and suspend or terminate access for any user who violates these rules, at our sole discretion and without prior notice where reasonable.
4. Your content and licence to us
You retain ownership of ASCII art and other content you create using the Service ("Your Content"). By submitting Your Content to the Community Gallery or any other public area of the Service, you:
- grant the Operator a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to host, store, reproduce, display, distribute, modify (for formatting, moderation, and technical adaptation), and make available Your Content for the purpose of operating, promoting, and improving the Service;
- warrant that you own or have all necessary rights, licences, and consents to grant this licence and that Your Content does not infringe any third party's rights or any law;
- acknowledge that other users may view, copy, and share Your Content as published in the public gallery, and that you are responsible for deciding what to publish.
We may decline, remove, or take down Your Content at any time and for any reason, without liability to you.
5. Moderation and reporting
Submissions to the Community Gallery are reviewed before they become public. To report content that violates these Terms or applicable law, use our notice-and-takedown procedure.
6. Intellectual property of the Service
The Service's name, design, source layout, original ASCII rendering pipelines, FIGlet bundling, and other materials produced by the Operator are protected by copyright and other laws. Nothing in these Terms grants you any right or licence to our marks or branding.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. We do not warrant that the Service will be error-free, that defects will be corrected, or that data will not be lost. You use the Service at your own risk. To the maximum extent permitted by law, we disclaim all implied warranties.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE OPERATOR'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) ten euros (EUR 10) or (b) the amount you have paid to the Operator in the twelve (12) months preceding the event giving rise to the claim (the Service is currently free of charge, so this is typically zero).
Nothing in these Terms limits liability that cannot be limited under mandatory law (e.g. liability for wilful misconduct or gross negligence under Czech Civil Code § 2898, or statutory consumer rights). Where a jurisdiction does not allow exclusion of certain warranties or limitation of certain damages, our liability is limited to the smallest extent permitted by that jurisdiction.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Operator from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right or applicable law.
10. Third-party services
The Service uses third-party providers (e.g. Google Analytics if you consent, Sentry for error monitoring, Hostinger for hosting). The Operator is not responsible for the acts or omissions of these third parties. Their terms govern your interactions with them.
11. Suspension and termination
We may suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms, with or without notice. We may also discontinue the Service in whole or in part at any time. Sections that by their nature should survive termination (including 4, 6–9, 12) survive.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive venue for disputes is the competent courts of the Czech Republic, save where mandatory consumer- protection rules in your country of residence provide otherwise. EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to these Terms
We may modify these Terms at any time. The current version always lives at this URL with the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance.
14. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, Cookie Policy, and DMCA Policy, constitute the entire agreement between you and the Operator regarding the Service.
